1. Purpose and Acceptance
Novitum Technologies OÜ (hereinafter, "PulseCosta", "us", or "the company") is the owner of the platform pulsecosta.es. Using the platform means full acceptance of these Terms. If you do not accept them, you must not use the service. These Terms govern access and use of PulseCosta, a real-time leisure platform (PWA) for the Costa del Sol, in its B2C (users) and B2B (businesses) modes.
2. Service Description
PulseCosta is a platform offering real-time venue occupancy data, personalized recommendations, booking tools, and access to deals across the Costa del Sol, from Nerja to Manilva. Basic user access is free, and Pulse+ costs 7,99 €/month. Venues may subscribe to Presence (39 €/month), Growth (89 €/month), or Intelligence (149 €/month). Plans and their features are displayed before payment. PulseCosta does not charge any booking or customer commission.
3. Subscription and Automatic Renewal
⚠️ Paid plans are billed and automatically renewed. By subscribing to a paid plan, you authorize Novitum Technologies OÜ to charge the amount to your chosen payment method at the start of each billing period (monthly or annual). Renewal occurs automatically until you cancel your subscription. You will receive an email notification prior to each annual renewal. Monthly renewals do not include a default pre-notice, although you may enable reminders from your profile. If payment fails, premium access will be suspended and you will receive an email to update your payment method. You have 7 days to resolve the issue before the subscription is permanently canceled.
4. Cancellation
You may cancel your subscription at any time via your profile → Subscription → Cancel plan. Cancellation takes effect at the end of the paid period. No prorated refunds are issued for unused days, except as required by law. Right of withdrawal: under EU Directive 2011/83/EU, you have 14 days from subscription to withdraw without cost, unless you have explicitly consented to begin using the digital service (in which case you waive withdrawal rights for the portion already consumed). You may also cancel by emailing soporte@pulsecosta.es with "Subscription cancellation" in the subject line.
5. User Obligations
The user agrees to: (a) provide truthful information; (b) not use the platform for illegal purposes; (c) not attempt to access restricted areas; (d) not distribute offensive or illegal content; (e) not perform scraping or mass data extraction.
6. Intellectual Property
All content on PulseCosta (code, design, branding, logos, data) is the property of Novitum Technologies OÜ or its licensors. Reproduction or commercial use without explicit authorization is prohibited.
7. Liability
PulseCosta provides occupancy data using the best available technology, but does not guarantee absolute real-time accuracy. We are not liable for decisions made based on platform data or for services provided by listed venues.
8. Applicable Law and Jurisdiction
These Terms are governed by Spanish law. For any dispute, the parties submit to the courts of Málaga, expressly waiving any other jurisdiction that might otherwise apply.
9. Use of Artificial Intelligence
PulseCosta incorporates artificial intelligence systems, including Pepito, to generate recommendations, answer questions, sort content, and produce predictions or estimates on atmosphere and demand. When users interact directly with AI, the interface indicates this. AI-generated responses, predictions, scores, recommendations, and other outputs are advisory, may contain errors, are not official information or professional advice, and are not binding. Users must verify information directly with the venue or organizer. Human oversight is applied to decisions affecting business visibility. We comply with transparency obligations under Regulation (EU) 2024/1689, effective from August 2, 2026.
10. Accessibility
Novitum Technologies OÜ qualifies as a microenterprise under Spain’s Law 11/2023, of May 8, which transposes Directive (EU) 2019/882 (European Accessibility Act): fewer than ten employees and annual business volume under two million euros. Under this status, part of the requirements in Annex I are waived. Nevertheless, PulseCosta is designed following WCAG 2.1 Level AA guidelines as a self-imposed standard.
